Some years ago, the El Cortez Hotel had a problem – due to high occupancy they badly needed another lift. But to do that, they had to close the hotel and cut a hole in each floor.

Then a janitor suggested, "Why not build the lift on the outside?" The experts were shocked, but they took it up and built the lift outside, the first time ever. The janitor was not problem-minded. He was opportunity-minded.

It was to popular that it got into number 4 on the iTunes charts. And the song was already 18 months also.

The video collected about 26,000 dollars in donations to end domestic violence.

Came back from class with the afternoon bus,

Looked kind of misty, Hobart's weather we trust.

Sat in my room quite comfortably, got to my assignment, ideas started to flow,

Looked out of my window, I saw what could be snow!

Took out my camera, snapped some shots of white,

Then came in Clarice, excited at the sight!

Could there be snow, not yet? maybe no?

But I caught a rainbow, a promise? of snow?

A rare sight nevertheless, one of Hobart’s best,

In which position do you sleep?

If you sleep on your stomach or on your left side, you are putting
pressure on your heart with the extra body weight, while the heart has
to continue pumping blood as usual.

This additional burden wears the heart out more quickly. Think
about it - you spend more than one third of your life sleeping!
To reduce the strain on your heart, sleep on your right side, or on
your back. This simple technique will add years to your life.

Avoid eye problems caused by T.V. and monitors.

The eye was not made to be constantly focused on close objects.
If your work requires that you stare at a computer screen all day long
or if you watch a lot of television, stop from time to time to do a few
eye exercises.

For example, roll your eyes in large circles in both directions;
look over to each side as far as possible and then go from up to
down; or scan an imaginary text on the wall from left to right; or look
out the window as far as you can following the horizon then return to
a point right in front of you and begin again.

In this way, you will avoid long term eye problems, you will
enlarge your inner space, and relax both your eyes and your mind.

What can you do if you do catch a cold?

It is useless to take antibiotics: they have no effect on viruses.
However, there are certain substances found in alcohol which help
decongest sinuses, that is why a good hot toddy can work wonders.
But take care of your liver: a toddy is just as good with a little rum as
with a lot.

You don’t have to get drunk to get better. You don’t even have to
drink it - just sniff some strong alcohol like cognac or brandy and
breathe in the fumes.

I just got off the phone with the producer of My Australia

and they've locked me in for 30th and 31st August. That would mean they would be coming when the Malaysian 'Merdeka' Dinner is organised!

Excited!

Oh yeah, I will be part of a TV program in an episode of My Australia.

This is what it is about:

My Australia
MY AUSTRALIA looks at Australia through the eyes of people from India and the Asia-Pacific region who are studying or living here.

In each episode a variety of people have new experiences and find out more about Australia.

The series is being produced by the ABC and will be broadcast by Australia Network to 44 countries in the Asia Pacific region.

I sent my resume, went through a Skype interview with ABC at Adelaide and got through all the paperwork.

Now is to prepare a story and roll out!

Walking

It is starting to sink in to me that next week will be one of the most stretching weeks of my life.

Feeling the stress sinking in, I decided that in order for me to take my mind of the coming week and get my head cleared up; I shall tell you a story.

Just yesterday, I needed to take pick up something from a friend’s place, 15 minutes walk from where I live.

I contemplated using my friend’s car or to take a walk up there.

My friend told me to walk, and tell me two lessons to learn from ‘walking’.

Me being me, I said, ‘why not, this should be fun’.

So there I went; walking along Regent street thinking about two random thoughts from walking.

Here are my written thoughts.

1. Walking keep you moving.

Motion creates movement which builds up the momentum. And momentum as the American football commentators say, ‘he has got the mo’ going on!’, which means that the footballer is in ‘it’ and is very likely to score for his team. In life, we need to keep the movement going.

We can’t stay stagnant wherever we are. It gets us nowhere. Everyone needs a destination to head to. And to begin with the end in mind. Also, when we’re taking that first step we’ve got to remember it is about ‘the journey not the destination’, as my friend kept reminding me while hiking up Mt. Taranaki (a dormant volcano) in New Zealand.

2. Keep on walking.

Those were the parting words of my Constitutional Law lecturer, Ms Savitha, as she ended the semester’s class. Once we’ve got the mo’ in us, we need to keep on walking, keep that pace. In one way, we’re all in a race, not to win, but to complete the race. As long as we cross the finish line, that is what matters. So the idea is to find out what race you’re in.

Also know that, ‘no man is an island’ and when you do that walking, (to sing the unforgettable line on matchday when Liverpool plays), You’ll never walk alone.

So when you walk, do life together. Walk together. And know that you’ll never walk alone.

One more thing, don’t forget to stop and smell the coffee/flowers!

I am reminded by my grandparents and parents that after the last of
the midnight chimes had heralded the arrival of Aug 31, 1957,
everyone was ecstatic. It was a stirring moment.
Malays grasped the hands of Chinese, Indians embraced Malays. With
'Merdeka', Malaysians felt energised.
Fast forward to present-day Malaysia and the scene is stupefying.
Malays eye the non-Malays with contempt and derision, whilst the
non-Malays are consumed with frustration and resentment. A neverending
nightmare.
The ties that cemented us 52 years ago have eroded. Instead of acting
as one, our differences have been emphasised; our similarities have all
but diminished.
The new slogan, 1Malaysia, is a vain attempt to patch-up our
differences. There is little point in using this sticking plaster to mend a
wound that is deep and suppurating.
If we are instructed to be 'one', then something is wrong. If we are
drilled to behave in a particular way, to be seen to be united, then this
is a veiled and tacit acknowledgment that all is not well.
Somewhere after independence, we lost our focus. We took our eye off
the ball.
We allowed ourselves to be massaged and manipulated into
submissiveness by those who purported to lead us, but who have done
us much damage - physically, spiritually, morally, financially,
emotionally.
We are now a bunch of apathetic people who have to be led by the
nose, who grumble only in private but hide any dissent in public. We
are cowed into inactivity, resigned to our fate.
Why do we allow racism, corruption or inequality, practices which are
unacceptable in the wider world, to prosper here? Why do we accept
that when something goes wrong, no one is made accountable? Why is
there a poor system of checks and balances? What happened to
leadership by example?

Mooting

Mooting, what does it mean?

It is derived from a Scandinavian word simply meaning 'meeting' or the assembly of people.

It came known went the vikings went to the UK and where legal debates ensued, it would be termed as mooting.

Now, mooting is known as a 'mock court' trial, like how lawyers present their arguments before Judges appealing a decision made the courts.

Why I wrote this?

Simply because I'm on a mini-high after joining my first mooting competition thanks to encouragement to participate and moot with Juin (the Tasmania Uni Law Society International Student Officer) Such a long title. lol.

I'm on such a high I'll just put down everything I said and what feedback I had.

Read at your own risk. This is legal jargon.

Before I enter that the legal eagle stuff, for my own self note, the feedback I got from the Judges was that I :
- Spoke clearly
- Was composed
- Remained calm
- (I like this) stuck to my guns. [the judge repeated asked me regarding a misrepresentation issue but I held to my argument and reiterated my point eventhough she tried to make me unsure about what I was arguing)
-Am a good arguer. lol. I checked what arguer means and wiki said, ' one who argues '.
-Answered questions well
- had to make clear my points and separate them out so I won't confuse myself ( kinda mixed up misrepresentation and implied terms)
- have to structure my points better
- speak not to 'rebut' the trial judge like a debate but to say that the judges 'erred', 'made a mistake' or was incorrect.
- Don't say I would like to submit, say I submit. [ our generation like to use the word 'like' lol]

Pretty much all. They say we should enjoy our faculty moots. I hope so it's 70% of my Constitutional Law assessment!

All in all it was serious heart pumping, gut wrenching, fist clenching fun. Should do it. Akin to a roller coaster. Live the life! lol.

That's it with what people call my 'verbal diarrhea'.

Here's my submission if you care to read. But don't bother unless you're interested in mooting.

This is regarding an illegality contract case and I was the counsel for the appellant.

Question:

Moot Question- Senior

Parties: Beau Brady and Brad Bridges v Rogue Star
Facts:
Beau and Brad have been together for 7 years and were desperate to have a child to make their life complete. They placed an advertisement in the Burnie Bugle that said:

Wanted: Surrogate
Must be resident in Burnie
Will pay $50,000 for services plus all reasonable expenses

Rogue was desperate for money, having just lost her job, and responded to the advertisement. She was the only person who lives in Burnie who did respond. Although Beau and Brad were worried about her motives, they agreed to proceed with the surrogacy. On 1 March 2009, all three attended the Burnie IVF clinic and Rogue underwent a procedure where she was inseminated with sperm donated by Brad. Unfortunately, the procedure was performed by a graduate student who failed to first check Rogue’s fertility status and whether Rogue was actually able to carry a baby. As it turned out, Rogue had cervical cancer in her late teens and had been told that she is infertile.

After the procedure was completed, Beau and Brad paid Rogue the $50,000 and went home to excitedly wait the pregnancy check-up in a month’s time. On 1 April 2009, Beau and Brad attended the Burnie IVF clinic with Rogue, only to find out that not only was she not pregnant, but that she will never be able to have children.

Distraught, Beau and Brad asked Rogue for their money back. Rogue refused and Beau and Brad commenced proceedings in the Supreme Court of Tasmania seeking to recover their $50,000 on the grounds of breach of contract.
At trial, the judge found in Rogue’s favour.

First, the trial judge found that Rogue did not misrepresent her capacity to have children and that it was not a term of the contract that Rogue warranted her capacity to have children.

Secondly, the trial judge found that even if she was wrong and the contract was induced by a misrepresentation or it was a term of the contract that Rogue warranted she could have children, the contract was void and unenforceable under s.7 Surrogacy Contracts Act 1993 (Tas).

Accordingly, as property in the $50,000 passed on delivery of the money to Rogue, Beau and Brad have no rights to recover the money.

Beau and Brad have appealed the decision.

My submission.

Submissions For Apellants (Beau and Brad)

Your Honour, with your permission, I Jason Lee, the counsel for the appellant, appealing for our client, Beau and Brad to bring justice to this matter, clarifying the vague facts to prove that my clients have the right to recover the $50,000 on the grounds of breach of contract.

Your Honour,
I will would like to highlight these three points as held by the trial judge,
1. That the trial judge’s finding that Rogue did not misrepresent her capacity to have children can be rebutted.
2. The trial judge’s finding that it was not a term of the contract that Rogue warranted her capacity to have children may be rebutted.
3. The trial judge’s finding that the contract was void and unenforceable under s.7 Surrogacy Contracts Act 1993 (Tas) is accepted but Beau and Brad should have the right to recover their money.

SPEAK SLOWLY and CLEARLY

I submit the first point that
1. The trial judge’s finding that Rogue did not misrepresent her capacity to have children can be rebutted.
According to Derry v Peek, it was held by the court that it was necessary
- Derry v Peek: In an action for deceit, it was necessary to prove fraud by showing that the defendant made a false representation knowing it was untrue or without belief in its truth, or recklessly, carelessly whether it was true or false (in its actions). This was not established on the evidence in this case, since the directors honestly believed that what they asserted was true.

On the facts, Rogue was actually expressing her ability to become pregnant when she responded to the advertisement by Brad and Beau. It is akin to the unilateral offer and acceptance (Carbolic Smoke Ball case). The acceptance by Rogue constitutes a representation that she can become pregnant and it is a false representation which Rogue made knowing it was untrue or that was made recklessly, since she was desperate for cash. She had also lost her job then and would have made a decision that was careless and reckless

Therefore your, Honour I submit that Rogue did misrepresent her capacity to have children because at that time she responded to the advertisement she was desperate for cash and lost her job causing her decision to be reckless and careless.

SPEAK SLOWLY and CLEARLY

To move on the second point Your Honour:
2. The trial judge’s finding that it was not a term of the contract that Rogue warranted her capacity to have children may be rebutted as well.

It is actually in the terms of the contact that Rogue warranted her capacity to have children may be rebutted as well. By the fact that Rouge agreed to be a surrogate mother, in means she has the capacity to have children and the fact that Beau and Brad did not received what they have paid for, they have the right recover their losses.

To bring forth a case in point Your Honour,
BP Refinery (Westernport) Pty Ltd v Shire of Hastings (1977) 180 CLR 266;
In the words of Lord Simon,
‘In the light of an associated agreement, it was something so obvious that it went without saying and if a bystander had asked whether that was the common intention of the parties the answer would have been “of course”. ‘

In this case, it is so obvious that the common intention of Beau and Brad in putting up the advertisement of a surrogate mother is to have a child. Therefore, Rouge must be able to become pregnant for the contract to be working. The fact that Rouge’s failure to become pregnant gives reason for them recover the $50,000.

In addition Your Honour, according to
Baltic Shipping Company v Dillon (1993) 176 CLR 344,
Mrs. Dillon could not recover the whole of the cruise fare on the ground of total failure of consideration, since she had enjoyed the benefits of the first eight full days of the cruise The court upheld an award of $5000 damages for disappointment and distress flowing from breach of the contract, since the object of the contract was to provide enjoyment and relaxation.

In this situation, the object of this particular contract was for Rouge to be a surrogate mother. Beau and Brad did not ‘enjoyed the benefits’ from Rouge’s offer to be a surroagate mother. The fact that in the end she did not fulfill the contract term to be a surrogate morther would give reason for Beau and Brad to cover the $50,000 that was paid in exchange for Rouge to be a surrogate mother.

SPEAK SLOWLY and CLEARLY

To my third and final point your honour,
3. The trial judge’s finding that the contract was void and unenforceable under s.7 Surrogacy Contracts Act 1993 (Tas) is accepted but Beau and Brad should have right to recover the money.

SURROGACY CONTRACTS ACT 1993 - SECT 7
7. Effect of surrogacy contract
A surrogacy contract is void and unenforceable wherever the contract is made and whatever law may be the proper law of the contract.
However, I submit that even if the contract was deemed void and unenforceable, Beau and Brad should be able to recover the $50,000.

Your Honour, in the case of Hatcher v White in the words of Street CJ
Street CJ in Hatcher v White (1953) 53 SR (NSW) 285, 288-289
‘…for in my view there emerges clearly the general principle that a claim may be made in fraud by an innocent person who is induced by untrue misrepresentations made by the other party that the agreement could lawfully be entered into, if it was not on its face one which was obviously unlawful. If, assuming the statement of facts to have been true, the transaction would have been legal, then the party defrauded is entitled to recover damages for any injury which he may have sustained by innocently entering into an illegal contract.’

Beau and Brad were induced by induced by untrue misrepresentation, placing themselves in a position, innocently on their part, and should be entitle to recover their losses. It would be unfair for Rouge to benefit from the ill-gotten gains at the expense of Beau and Brad.

SPEAK SLOWLY and CLEARLY

I would like to submit therefore your Honour that,
1. The trial judge’s finding that Rogue did not misrepresent her capacity to have children can be rebutted.
2. The trial judge’s finding that it was not a term of the contract that Rogue warranted her capacity to have children may be rebutted.
3. The trial judge’s finding that the contract was void and unenforceable under s.7 Surrogacy Contracts Act 1993 (Tas) is accepted but Beau and Brad should have the right to recover their money.

Your Honour, I shall conclude my submission on behalf of the appellant unless I can be of further assistance to your Honour.

Today I went to observe the Kids ministry in my church in Hobart, Kidz City.

Noted some interesting things, the children there are more responsive to your questions and they're always eager to answer your questions.

They're extra friendly to you too! Went I came entered the room, I was introduced to the 40 or so children by Pastor Libby. Right after a welcome note and an offering message (yes they have an offering message for children!), Pastor Libby invited all the 3-5 year olds to go to the basement where they would have their classes. She asked them to look for a partner and buddy up to walk down together. I was unsure whether to join the class or not until this young boy, named Lockie, came to me and said, "Hi Jason, can I be your partner?". He reached his tiny little 4 year old arm to me and that made my day..

In the room when Pastor Libby asked everyone to sit on the 'red mat' so that she could tell them a story, (red mat to set the boundary for them) I warmed up to the kids and sat next to some of them. This time, Hugh came to me and sat on my right,saying, "I want to sit next to you because I love you...".

Yokay. hahaha.. kids in Australia!

A month goes by...

I've decided, from today onwards, 10th March 2009, I'm going to take 15 minutes a day to write. Yes just write about my life, things I do and learn been inspired and influenced to do, no holds barred.

Well, this moment is very opportune as this month in review cause as of tomorrow I would be spending exactly one month in Tasmania.

To quote the movie " The curious case of Benjamin Buttons", 'Life is defined not in minutes. But in moments".

I'm getting used to the environment and the culture here, everything is not to hard to get by though it may be challenging

I've:

Learned to shop wisely and look out for good buys knowing I'm on a budget.

Learned to plan things ahead, not just in my studies, but my meals, cleaning up, ironing the clothes, going to church and events and so on.

Learned to cook! Thought slowly, I hope to learn a few special recipes and awesome dishes to bring back to M'sia!

Learned to take responsibility of my own life knowing that I'm here by myself (though with support of friends) but to be independent in my lifestyle

Learned to appreciate friends who selflessly drive you to church, captain ball and so on, teach you and show you to best things to do and the right time, being just available!

Learned to not forget where I came from, Malaysia! And to keep on check what's been going on in this nation I call home. (Malaysiakini.com has been great!)

The fact is still there though, I miss home.

I miss the moments I don't need to worry about petty stuff like what to eat for dinner or to make sure I clean up after my mess. Lol.

I miss the moments where I get to see my good friends every week or catch up with 'ol buddies over a meal anytime.

I miss the moments I get to play around with my cousins, tell them stories or do silly things like lift up 'lil Man Jan high in the sky after giving the '1,2,3' countdown; who won't be so little by the time I see him.

I miss the moments I get to give a big hug, more like a squeeze to all the young kids in church or my cousins.

I miss my family, knowing I get to talk to them easily and ask for money whenever I'm in need =b

I miss my classmates, school and 'busy' life I had. I just do.

11-14th December 2008 would be 4days3nights to remember for me. dO iT camp.

I served as the Camp Commander alongside Sarah for this camp.

Random thoughts for now.
( More to come when I get enough sleep, energy and brain power to share about it)

After speaking over the microphone and hailer so much, every time I speak to someone I feel my voice is being projected to everyone.

I slept a total of 13 hours during the whole camp.

Camp had no rules. I liked that.

103 campers, 4 New Life Churches, 1 Place.

Flour, Eggs, Shaving Cream, Fart Bombs.

We stayed in the firm today and did a research on the setting of Private Pension Funds in Malaysia. This sentence is short, but the research ain’t. I can assure you of that!
We called Ministry after Ministry, private companies and e-mail consultants.

Later, we proof read the Facility agreement which we typed out. For 3 hours! Yes it’s a long article alrtie.

Looking back after I go through my time in Cheang&Ariff, I knew that what I’ve learn would be invaluable lesson in my journey as a student and stint as a Chambee.

Although sometimes it may be tough,
The people and places that may be rough,
Or do routine work and boring stuff,
The times that make you think you had enough!

But they’ll always be the times we’ll laugh.

Welcome to the 'Kompleks Mahkamah Kuala Lumpur'

At a final cost of RM290 million, I'm still wondering whether the newly-constructed court in 2007 can help solve the issue of a lack of judges and courts in the country.

Federal Court chief registrar Datuk Tengku Maimun Tuan Mat (as reported in New Straits Times, 20/9/2006), disclosed that the number of judges in the country was low compared with other Commonwealth nations. He was quoted as saying that the Malaysian ratio is "2.4 judges to a million people - a far cry from the ratio in India (10.5), Australia (57.1), Britain (50.1) and Canada (75)." - Malaysianbar.org

The front and grand entrance of court, notice the 'Buat Kerja' slogan? If you've worked with or in and a government department in Malaysia, get use to slogans. That don't work.

It takes a lawyer to walk for at least 10 minutes straight to walk from one end of the courtrooms to the other end. No wonder it is the largest court complex in the world.

We had the opportunity to follow Mr.Rajah, another two decade work experience guy. He showed us how to extract documents, make payments, check the B.C Box, take note of places we may go to often and basically shared everything we needed to know about this Courts Complex.

During our break time. We tried their Pisang Goreng and Ubi Keladi. Court Cafeteria food are cheap and good!

This was followed by a mouth-watering Banana Leaf meal which Mr. Rajah belanja-ed (spent) us along the Jalan Ipoh. I Love Banana Leaf. Especially with an assortment of ori-indian stuff added along with that generous scooping of papadum. Haha.. only thing is that all the rice, spice and everything nice makes you sleepy during work..

We went back to work and continued by sorting a whole stack of Sale & Purchase agreements, sorting them by dates in boxes and fitting misplaced receipts into the designated files. 6 boxes and a cup of coffee later, It was nearly 6 and time to go home!

It was a full, but fun day!

Your first week may be depressing being far from home but after meeting good friends and nice lecturers, you don’t want to come home already! The environment is good and quiet; there is no form of discrimination. Never skip classes! You will have a bad time preparing from exams after that! The stress of not doing well and telling your parents is not worth it!. This would be only one experience in life, make full use of it. When you’re there and when you come back, you’ll understand the difference between KL and Tasmania!

It was an inspirational talk no doubt, she even shared about it in her blog!

5th Day @ work.

We experience our first KL morning traffic rush. It’s mad. Now I understand the notoriety and name KL drivers make of themselves.

A creative advertisement by the Regalia Service Apartments. Everybody who’s stuck in this jam daily see this every day. Maybe someone may actually purchase a unit after the constant ‘visual harassment’ coupled with the unbecoming traffic.

Today at Cheang&Ariff was an interesting day, we had a lecture with Mr. Azhar Azizan about ISA and the recent RPK Habeas Corpus case. It’s really amazing to read the news regarding RPK being released from ISA through proper and impartial court proceedings with the privilege or reading the submissions by both government and Mr. Azhar’s side. He was part of the defense counsel for Raja Petra. We actually learned the technical aspect of ISA and dwelled in Section 8B and 73. (more details would breach the client-lawyer privilege.. haha, it’s nothing la.) Btw, Mr. Azhar is a Corporate division Partner who specializes in shareholders dispute, boardroom fight and Insolvency cases (recovery of debt) and restructuring work. He helps out in public interest cases like this RPK case and the Lingam commission sometimes representing a few NGOs.

Basically, we learned a few things like the difference between punitive legislation (Courts) and preventive legislation (ISA) and the writs available through judicial reveal.
In comprehendible terms,

Mandamus : ‘To do something’
Certiorari : ‘To set aside an act’
Prohibition : Injunction (prevent the government from doing something)
Habeas Corpus : ‘Produce the body’ (literally) –Bring the person to court to be trialed.

Soon after, we had another lecture by Ms. Cindy Goh with the chambering students regarding trademark application.

“A Trade Marks is a sign which distinguishes the goods and services of one trader from those of another. A sign includes words, logos, pictures, names, letters, numbers or a combination of these and is used as a marketing tool to enable customers in recognizing the product of a particular trader. “

Being a registered trademark, patent and industrial design agent, she spoke knowingly with everything from the back of her head! Ms. Cindy explained the procedures for a trademark application which was really interesting. For example, religious word like ‘hallelujah’ cannot be trademark nor offensive words like *#@&!%!.

For those applying for a trademark, they have to go through a registered trademark agent (lawyer) who will explain some gibberish and legal jargon before informing them that ‘Borang TM-1 and TM-5’ need to be filled which are’ Form Of Authorisation And Request To Enter, Alter Or Substitute An Address For Service’ and ‘Application For Registration Of A Mark’ forms respectively. It actually feels like being a doctor, client has a problem/application, lawyer diagnoses problem/application and solves it with some legal help. I like it.

Went out for Lunch where Mr. Chong belanja-ed us the Spicy Chilli Pan Mee, one of the most famous eatery in KL.

We then visited the KL Land Office. It is pretty much the same as the Petaling Land Office except that it’s much bigger and older. At that same building is where the ‘Badan Pencegah Rasuah’ (Anti Corruption Agency) is and where an auction house seats. The chairs are however more comfortable than other offices. Haha..

Came back and immediately was given to transcribe 47-pages of a ‘Facility Agreement’ for property purchase. Thank God we divided the work between 5 people. 16,000++ words (combined) later and about almost 3 hours (till after office hours). By 835pm,

Mr. Chong dropped by and welcomed us to the life of a lawyer for the day. Despite the doze-offs and draggy typings, we learned the art of delayed gratification (discipline!).

One notable observation is that most lawyers and chambees still stayed back to work till then even after majority of the staff have left for home. They stay not because they have to but because they need to!

4th Day @ Cheang & Ariff

Monday morning, my fourth day but the first day for my law attachment KDU-UTAS mates, Yoke Hang and Pui San. I got a feeling this is just one of the many 'group photos' we'll take.. =b

As how Kellie showed me the places and faces during my first day, we were shown around the Loke Mansion and introduced to the staff in Cheang&Ariff, We then had a talk with Mr. Chong (our Master - what they call the person-in-charge over you during your stint in a law firm) about the firm and what the next whole month of practical training would be like.

Above is the filing room in the 2 big containments where all files over the last few years are stored. Next to the Loke Mansion is the ‘Loke Yew Pavilion’ , a big storeroom where all the miscellaneous ‘dan lain-lain’ stuff are kept.

Our first assignment of the day was by Ms. Carol and it was to key in details and sort out letters for claimants of late delivery of apartment units. Quite a daunting task, seeing a huge stack with over 150 letters!

This is one of the books written by Dato’ Loh. He is a prominent figure in the corporate legal world and almost all the law firms in Malaysia has his book in their libraries. He also pushed for the idea of ISO-ing law firms and thus Cheang&Ariff is the first firm in ASEAN to be ISO-Certified.

After lunch, we followed Mr. Ratha to the Petaling Land Office (Pejabat Tanah Dan Daerah Petaling) which is a government agency that records land claims, loans patents, and possibly deeds. Lawyers normally make use of the land office when they would want to conduct a search on their client’s property, whether the property has the right owner or the land title is safe to buy - to ensure that there is no strings attached to it!

For example in the search for property, they’re a few types of ‘carian’ which are carian rasmi, carian persendirian or salinan sah hak milik.

Basically this building in Subang Jaya is the Petaling District office compromising of various departments but the land office is only department of interest to Lawyers. Mr. Ratha has been in the dispatch departments for 20 years now and has been a pro when it comes to all these. Sometimes he even drives all the way to Alor Setar Land Office in Kedah (Bout 5hours drive) to do confirm a property search there.

We learned about the ‘Caveat’ which is Latin for "beware". Usually it is in the form of a contract clause that stipulates a particular requirement. It is a formal notice or warning against certain actions being taken by a court; most often seen in regard to the granting of probate of a will by the court; most common usage as a document that is filed in the Land Titles Office to warn of possible title defects.

All in all, today was a day of learning. One thing we learned for sure is we’re not taking the LRT anymore and Yoke Hang will be fetching us from tomorrow onwards! Thank God! No more waiting in line and squeezing like sardines every day!

3rd Day of my Law attachment.

Nov 7, Friday: Today is the day when ‘monthly drinks’ would be held where the chambees would organise a gathering with the lawyers for a night in Loke Mansion with a light dinner and some wine/drinks. It’s a monthly tradition where everyone just gets to unwind and have a down-to-earth chat with one another apart from the daily stress we all get! It’s a unique activity, not sure if other law firms do this as well but I think it’s a brilliant idea, cause there’s food, fun and fellowship! Anything with the 3F’s are sure-fire good stuff!

With all planned up the day before, we headed for Cold Storage to get the ingredients for the killer mocktails and out-of-the-world bruschettas we planned to do. Haha..

We also got this Jelly Cake from Qjelly from The Curve after the lunch @ Kluang Station. Above is Yvonne and Mei Ching, both Chambees. Oldest and youngest chambee out of the 7. =b

Back at the C&A Pantry, our storage place! And what is to be later will all come out from this fridge when the time comes.. Contrary to popular opinion that may entail, no, we didn’t drink all that beer! The mocktails were better! Haha..

At 5.30pm we all came down to prepare the food, slice the nasi impit, dice the mint leaves and parsley and make the Bruschetta ala Turkey Roast and Tuna Dressing. Above are the Chambees, missing and only guy is Vincent (Sick =p). From left: Yvonne, Tricia, Mun Wei, Fui Yau, Mei Ching and Hui Jiun.

Toasting the work of art: French loaf with Garlic butter spread, added with Turkey Roast/Tuna Dressing topped with half a tomato, Mozarella Cheese and Parsley! Prepare for toast for 3-5minutes and there you go! Oh yeah, sprinkle a pinch of ground pepper to complete the Bruschetta. Yumm.. Just typing it out makes me hungry..

Finally! The result! Yes, it tastes as good as it looks!

Next is my very own creation the ‘Loke Mansion Mohito’ Mocktail! The ingredients above were added in order from left to right and bought in Cold Storage. Portions are up to your taste.

Soda : For the Fizz
Ribena : Blackcurrent flavor
Lime Juice : Sour taste
Ginge ale : Spiciness!
Fruit Cocktail : Finishing touch!!

Along with the other mansion-made food and drinks are 3 pizzas and 13 spaghetti(s) from from Izzi restraurant. Yupp we got ‘em for the now 75% off for every RM150 and above purchase! Worth the buy I must say.

Yupp, this is part of a life in Cheang&Ariff and it’s good. It brings the human out of all the lawyers and the lighter side of things. I got to know the Chambees a lot better too, just thinking of what I did for the last three day assured me that this would be time well spent during my holidays. Looking forward to getting to know ya ‘all more!

My bad, for the lack of intellectual postings, for now, this blog is for me to just unwind and an opportunity to 'report' what I do in work during office hours. =p

Meet Yoke Hang, she’s a 2nd year law student and will be going to continue her studies in Tasmania next year too. Thanks to her we don’t need take the LRT to work now, she drives us to work and has a DVD player in her car! =D Watched ‘The Great Debaters' today. She is the girl-next-cubicle (literally!), garang sometimes, walks very fast, always want to diet but always fail. =b

Then there’s Pui San, the girl whom we’ll remember regretted wearing high heels on her first day to work -we walked very often. She’s a Sem4 student, frequent toilet user. She’s a coffee drinker, likes her chilly Pan Mee (KL famous and walking distance) and snores in the car. =b

(Still getting to know the both of them, more will come soon! Every word has been endorsed by them btw)

In the name of ‘justice and equality’ as requested by the them, I shall introduce myself as an attachee in C&A. According to Yh and Ps, I talk a lot, look like a busy businessman, my Master (Mr.Chong) says I can pull off as a lawyer those I have to work on some office etiquette, I camwhore, take pictures all over the building except the toilets (=p) and Ps thinks my butt is proportionally larger. =p

2nd day of law attachment.

930am The first part of the afternoon was spent assisting Mr. Abdullah in his research work regarding Section 23 of the Evidence act in relation to ‘communication without prejudice’. Found an extremely applicable Federal court case along with some High Court cases from the MLJs and CLJs in the Library.

11am Surfed the Bar Council website. Good read inside!

1145am Introduced to Mr.Chong who briefed me on the program, more to come when Yoke Hang and Pui San come in on Monday. Program divided to three parts, field trips, file research and interactive lectures. Looking forward to it! Of course la, no allowance provided. =b

Mr. Chong introduced me to 3 partners, Ms. Siew, Ms. Cindy and Mr. Azhar. They are to hand me files to research or assist them in their work. (No pictures to be taken unless permission given)

12.15am Received an intellectual property (IP) file from Ms. Cindy, Very interesting. Regarding a trademark request by Nissin Company in Japan. They wanted to officially trademark the name ‘NISSIN FOODS’. Going through the files, forms (TM1 & TM5) and process of the application. Fresh application Oh! To think that I sometimes I eat these noodles at home!

12.45pm Lunch : We went to Jack’s place the restaurant famous for ‘roti babi’! haha.. tried their pork chop there. Not bad. But RM9 la..

2pm Went through more IP files and Rose (the librarian) showed me their archive of bills and acts. I went through the masterlist of all the acts enacted in Malaysia. Comprehensive. Guess what? I found Malaysia’s parallel of our Misuse of Drugs Act 1932 (MODA) in Australia! (We are allowed to bring this act into our criminal law examination for citation purposes). It’s called the Dangerous Drugs Act 1952. It has the same format defining trafficking and so on! How interesting is that!

Haha.. there was that law-geek rush of excitement moment seeing how I could possibly apply this in the future..

I will be joining the Chambees for a meeting to prepare for the 'monthly drinks', a gathering amongst attachment students, chambering students, lawyers, junior lawyers, associates and partner for food and fellowship.

(Btw, that’s pretty much the ladder any aspiring law student has to climb to reach Partner status.)

Meeting with Chambees , 10 of us regarding the monthly drink, got some good ideas coming up, the result of it will be in the pictures tmrw! Haha.. Besides researching law reports, now I search on how to make killer mocktails and out-of-the world bruschettas~

First day of my law attachment @ Cheang&Ariff

Just two days ago, I accepted an offer to complete a law attachment in Cheang&Ariff, a law firm located in the heart of Kuala Lumpur.

This is part of a program KDU is organizing to encourage students to be exposed to the working world and find out what the legal eagle life is all about. Haha.. I’ve heard many sides of many stories and here I am on my first day to find out working at a law firm would be like.

Welcome to Cheang & Ariff, this is the first day of my one month stint in the famous Loke Mansion.

Took the KJ Station LRT ride to Dang Wangi and had a nice 15 mins stroll pass Sheraton Hotel along Jalan Sultan Ismail.

This firms had about 11 partners and 11 lawyers and in total 50 over people working there including the tea lady, librarian, client care partner and even a full time cleaner!

Today, I will not introduce anyone as of now as the HR secretary introduced me to majority of the people in the whole firm in 15mins! It felt that I was introduced for namesake, haha.. how to remember all their names, they're people from the ground floor, first floor, balcony side, library, HR/Operations room and so on..

My temporary working place at the library, right in front is the 'Moongate'. Special designated area for VIP clients. The music stand thingy are before-after shots of the Loke Mansion. Basically the firm bought this heritage building for a 15-year lease and refurbished and renovated the whole place.

This is one half of the library where all the law journals, reports and acts are kept. Most of the time you’d see attachments students or chambees slaving for their lawyers. =p

1/4 of their filing rooms. Yes, it goes to the thousands. It's compilation of all the Corporate & Securities, Banking & Conveyancing, Litigation and Dispute Resolution and Intellectual Property and Information Technology work that they do.

I had to wait for a lawyer who would introduce me to this one month structured plan which he prepared for attachment student but he did couldn't come to office, held up in court so I explored the firms internal website, read their 59-page handbook and browse through pictures of their trips and parties (yes they even have a portion for recreation). Checked the court lay-outs and read some pretty long-winded guideline on having good English in letters and submissions. Yes, I was too free.

Went for the hour-long lunch with a lawyer and two chambering students having Indian 'Chap Fan' but not 'Chap Fan' prices la.. super $$.

While waiting I spent the time I had there checking some law journals and interesting acts. Of course, I managed to check out the once controversial Universities and University Colleges Act (UUCA) 1971. Gist is, the act doesn't allow students to get involve, show interest, sympathy or concern with 'outside' societies and political parties. It's long story but if you have the time, check out LKS and Jeff Ooi talking about it.

After that, I headed to the HR/ Operations room to learn the filing system there. I jot down the details and KIV dates of about 70 files, it's for lawyers to refer too.

It's an e-filing system. Very well planned out and organised. Every morning, a team would carry the designated files up from the containment room to the lawyers' office (1st floor) and in the evening you'd see them carry down the completed files. Some days they're up to 300 files to settle! There's all sort of cases, property agreements and banking in the files.

All in all, it looks like a promising one month, can't wait to find out what would entail nexts!

I was browsing through the net to see what the one of the newly elected 'most-powerful-person-on-earth' would say, and boy do I believe now that this guys has got what it takes!

CHICAGO, IL: Herewith is the full text of president-elect Barack Obama's victory speech Tuesday before a crowd of some 125,000 cheering and teraful supporters:

"If there is anyone out there who still doubts that America is a place where all things are possible; who still wonders if the dream of our founders is alive in our time; who still questions the power of our democracy, tonight is your answer.

"It's the answer told by lines that stretched around schools and churches in numbers this nation has never seen; by people who waited three hours and four hours, many for the very first time in their lives, because they believed that this time must be different; that their voice could be that difference.

"It's the answer spoken by young and old, rich and poor, Democrat and Republican, black, white, Latino, Asian, Native American, gay, straight, disabled and not disabled Americans who sent a message to the world that we have never been a collection of Red States and Blue States: we are, and always will be, the United States of America.

"It's the answer that led those who have been told for so long by so many to be cynical, and fearful, and doubtful of what we can achieve to put their hands on the arc of history and bend it once more toward the hope of a better day.

"It's been a long time coming, but tonight, because of what we did on this day, in this election, at this defining moment, change has come to America.

"I just received a very gracious call from Senator McCain. He fought long and hard in this campaign, and he's fought even longer and harder for the country he loves. He has endured sacrifices for America that most of us cannot begin to imagine, and we are better off for the service rendered by this brave and selfless leader. I congratulate him and Governor Palin for all they have achieved, and I look forward to working with them to renew this nation's promise in the months ahead.

"I want to thank my partner in this journey, a man who campaigned from his heart and spoke for the men and women he grew up with on the streets of Scranton and rode with on that train home to Delaware, the Vice President-elect of the United States, Joe Biden.

"I would not be standing here tonight without the unyielding support of my best friend for the last 16 years, the rock of our family and the love of my life, our nation's next First Lady, Michelle Obama. Sasha and Malia, I love you both so much, and you have earned the new puppy that's coming with us to the White House. And while she's no longer with us, I know my grandmother is watching, along with the family that made me who I am. I miss them tonight, and know that my debt to them is beyond measure.

"To my campaign manager David Plouffe, my chief strategist David Axelrod, and the best campaign team ever assembled in the history of politics you made this happen, and I am forever grateful for what you've sacrificed to get it done.

"But above all, I will never forget who this victory truly belongs to it belongs to you.

"I was never the likeliest candidate for this office. We didn't start with much money or many endorsements. Our campaign was not hatched in the halls of Washington it began in the backyards of Des Moines and the living rooms of Concord and the front porches of Charleston.

"It was built by working men and women who dug into what little savings they had to give five dollars and ten dollars and twenty dollars to this cause. It grew strength from the young people who rejected the myth of their generation's apathy; who left their homes and their families for jobs that offered little pay and less sleep; from the not-so-young people who braved the bitter cold and scorching heat to knock on the doors of perfect strangers; from the millions of Americans who volunteered, and organized, and proved that more than two centuries later, a government of the people, by the people and for the people has not perished from this Earth. This is your victory.

"I know you didn't do this just to win an election and I know you didn't do it for me. You did it because you understand the enormity of the task that lies ahead. For even as we celebrate tonight, we know the challenges that tomorrow will bring are the greatest of our lifetime, two wars, a planet in peril, the worst financial crisis in a century.

"Even as we stand here tonight, we know there are brave Americans waking up in the deserts of Iraq and the mountains of Afghanistan to risk their lives for us. There are mothers and fathers who will lie awake after their children fall asleep and wonder how they'll make the mortgage, or pay their doctor's bills, or save enough for college. There is new energy to harness and new jobs to be created; new schools to build and threats to meet and alliances to repair.

"The road ahead will be long. Our climb will be steep. We may not get there in one year or even one term, but America I have never been more hopeful than I am tonight that we will get there. I promise you we as a people will get there.

"There will be setbacks and false starts. There are many who won't agree with every decision or policy I make as president, and we know that government can't solve every problem. But I will always be honest with you about the challenges we face. I will listen to you, especially when we disagree. And above all, I will ask you join in the work of remaking this nation the only way it's been done in America for 221 years block by block, brick by brick, calloused hand by calloused hand.

"What began twenty-one months ago in the depths of winter must not end on this autumn night. This victory alone is not the change we seek it is only the chance for us to make that change. And that cannot happen if we go back to the way things were. It cannot happen without you.

"So let us summon a new spirit of patriotism; of service and responsibility where each of us resolves to pitch in and work harder and look after not only ourselves, but each other. Let us remember that if this financial crisis taught us anything, it's that we cannot have a thriving Wall Street while Main Street suffers in this country, we rise or fall as one nation; as one people.

"Let us resist the temptation to fall back on the same partisanship and pettiness and immaturity that has poisoned our politics for so long. As Lincoln said to a nation far more divided than ours, 'We are not enemies, but friends though passion may have strained it must not break our bonds of affection.' And to those Americans whose support I have yet to earn I may not have won your vote, but I hear your voices, I need your help, and I will be your president too.

"And to all those watching tonight from beyond our shores, from parliaments and palaces to those who are huddled around radios in the forgotten corners of our world our stories are singular, but our destiny is shared, and a new dawn of American leadership is at hand. To those who would tear this world down we will defeat you. To those who seek peace and security we support you. And to all those who have wondered if America's beacon still burns as bright tonight we proved once more that the true strength of our nation comes not from our the might of our arms or the scale of our wealth, but from the enduring power of our ideals: democracy, liberty, opportunity, and unyielding hope.

"For that is the true genius of America that America can change. Our union can be perfected. And what we have already achieved gives us hope for what we can and must achieve tomorrow.

"This election had many firsts and many stories that will be told for generations. But one that's on my mind tonight is about a woman who cast her ballot in Atlanta. She's a lot like the millions of others who stood in line to make their voice heard in this election except for one thing--Ann Nixon Cooper is 106 years old.

"She was born just a generation past slavery; a time when there were no cars on the road or planes in the sky; when someone like her couldn't vote for two reasons because she was a woman and because of the color of her skin.

"And tonight, I think about all that she's seen throughout her century in America the heartache and the hope; the struggle and the progress; the times we were told that we can't, and the people who pressed on with that American creed: Yes we can.

"At a time when women's voices were silenced and their hopes dismissed, she lived to see them stand up and speak out and reach for the ballot. Yes we can.

"When there was despair in the dust bowl and depression across the land, she saw a nation conquer fear itself with a New Deal, new jobs and a new sense of common purpose. Yes we can.

"When the bombs fell on our harbou and tyranny threatened the world, she was there to witness a generation rise to greatness and a democracy was saved. Yes we can.

"She was there for the buses in Montgomery, the hoses in Birmingham, a bridge in Selma, and a preacher from Atlanta who told a people that 'We Shall Overcome.' Yes we can.

"A man touched down on the moon, a wall came down in Berlin, a world was connected by our own science and imagination. And this year, in this election, she touched her finger to a screen, and cast her vote, because after 106 years in America, through the best of times and the darkest of hours, she knows how America can change. Yes we can.

"America, we have come so far. We have seen so much. But there is so much more to do. So tonight, let us ask ourselves if our children should live to see the next century; if my daughters should be so lucky to live as long as Ann Nixon Cooper, what change will they see? What progress will we have made?

"This is our chance to answer that call. This is our moment. This is our time to put our people back to work and open doors of opportunity for our kids; to restore prosperity and promote the cause of peace; to reclaim the American Dream and reaffirm that fundamental truth that out of many, we are one; that while we breathe, we hope, and where we are met with cynicism, and doubt, and those who tell us that we can't, we will respond with that timeless creed that sums up the spirit of a people:
